Please read these Terms of Service (“Terms”) carefully. By purchasing, accessing, or using our websites, software, templates, funnels, and related services (“Services”), you agree to these Terms.

Who We Are

Professional Insight, LLC, doing business as Pro-Sight Property Inspections (“Pro-Sight,” “we,” “us,” or “our”), provides inspection reporting software, conversion-ready website templates, setup services, and optional add-ons such as email and funnel integrations, SEO, and Google Business Profile optimization.

Data Retention and Account Activity

Customer data, including inspection reports, images, and related files, is stored as part of the active subscription service.

Inspection reports generated in HTML format are typically retained for up to five (5) years while an account remains active.

Accounts associated with a Lifetime Membership (limited time offering) are provided ongoing access to the reporting software without a recurring monthly or annual subscription fee. All Lifetime subscriptions have a yearly platform access fee of $45.00. Lifetime Membership refers to continued access to the reporting software. HTML inspection reports created under the Lifetime Membership plan are typically retained on our servers for up to one (1) year from the date the report is created, after which they may be removed as part of routine system maintenance. Lifetime access refers to the lifetime of the Pro-Sight Property Inspection Software service while it is actively operated and supported.

If a subscription is cancelled or expires, account access may be suspended and data associated with the account may be retained for up to 30 days to allow the customer to download or export their information. After this period, the data may be permanently deleted from our systems.

Accounts with no login or platform activity for nine (9) months or longer may be considered inactive and may be subject to data removal to maintain system performance and security.

Customers are responsible for maintaining their own copies of inspection reports and related data.

We do not guarantee long-term storage of inspection reports or account data beyond the periods described above.

We do not guarantee continuous availability of report links, stored files, or hosted content.

Recommended Best Practice for Report Backup

Inspectors should always email both the HTML report link and the PDF version to the client. Using an email account such as Gmail to send reports ensures a copy of every report remains stored in your sent email history, providing an additional backup.

Website

What You’re Buying: You’re purchasing access to a template-based website package and related materials as described on the applicable sales page or order form. Unless explicitly stated otherwise, delivery is digital and fulfilled by providing template access, setup, or files. Physical goods are not included.

License and Use

You receive a non-exclusive, non-transferable license to use the templates and content for your own business. You may customize them, but you may not resell, redistribute, sublicense, or share our templates, copy, designs, code, or training as your own product.

Your Responsibilities

You are responsible for:

• Providing accurate business details, logos, images, and any content you want placed on your site.
• Complying with laws that apply to your business, including advertising, privacy, accessibility, and industry-specific regulations.
• Maintaining your accounts with third-party tools we integrate or connect to (hosting, domains, email services, analytics, payment processors).
• Reviewing deliverables promptly so we can complete setup on schedule.

Our Deliverables

We provide the pages, sections, and setup listed on the sales page at the time of purchase. Placeholder copy is included to show structure and can be kept, edited, or replaced.

Where noted, we will connect available integrations that you authorize. Some features require active third-party accounts or credentials.

Timelines are estimates and depend on receiving required information from you.

Subscription Billing

If your purchase includes a subscription, it will renew automatically at the stated interval until you cancel.

You may cancel future renewals at any time before the next billing cycle by following the instructions in your receipt or account area.

All fees are charged in advance and are non-refundable unless otherwise stated in writing.

Changes and Updates

We may improve or update templates, software, and supporting materials over time. Where feasible, we will provide access to the latest version of the materials you purchased.

We may modify these Terms at any time. The “Last updated” date reflects the current version.

Intellectual Property

All templates, designs, copy, code, training materials, documentation, and brand assets remain the intellectual property of Professional Insight, LLC.

Your license allows use in your own business but does not allow resale, redistribution, or reproduction as a competing product.

Third-Party Services

Our Services may integrate with or link to third-party platforms. These platforms have their own terms of service and privacy policies.

We are not responsible for third-party outages, service interruptions, pricing changes, data handling, or platform policies.

Results Disclaimer

Templates and marketing tools may improve lead flow and sales when used properly. However, results vary based on your market, competition, execution, and business practices.

We do not guarantee specific rankings, traffic levels, leads, sales, or revenue.

Attribution and Analytics

If UTM tracking or analytics are included, we will configure standard tracking where possible. Data accuracy depends on browser privacy settings, ad platforms, connected accounts, and third-party tools.

Support

Support is provided typically via email during normal business hours.

Support covers assistance with the included templates, software features, and integrations. Custom development, design work, copywriting, or additional services may be available for an additional fee.

Prohibited Uses

You agree not to use our Services to publish illegal content, infringe intellectual property rights, distribute malware, engage in deceptive marketing, or violate applicable laws.

We may suspend or terminate access for violations without refund.

Service Availability

We strive to maintain reliable service but do not guarantee that the Services will be uninterrupted, secure, or error-free.

Temporary downtime may occur due to maintenance, updates, server issues, or third-party service disruptions.

Limitation of Liability

To the maximum extent permitted by law, Professional Insight, LLC and its team will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from the use of our Services.

Our total liability for any claim related to the Services will not exceed the amount paid for the specific Service during the 90 days preceding the claim.

No Professional Advice

We provide software tools, templates, and general marketing guidance. This does not constitute legal, financial, tax, or professional advice. You should consult qualified professionals for advice specific to your business.

Indemnification

You agree to indemnify and hold harmless Professional Insight, LLC from any claims, losses, liabilities, or expenses arising from your content, your use of the Services, or your violation of these Terms or applicable laws.

Termination

We may suspend or terminate access to the Services if you violate these Terms or misuse the Services.

You may terminate at any time by cancelling active subscriptions. Past charges are not refundable unless a written guarantee specifically applies.

Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law principles.

Any disputes arising under these Terms will be resolved in the courts located in Maricopa County, Arizona, unless applicable law requires otherwise.
